Boudin Oy (later “we”) is committed to protecting the privacy of the users of our services, and comply with General Data Protection Regulation (GDPR) of the European Union (2016/679/EU), which was applied as of 25th May 2018, as well as other Finnish and EU data protection legislation while processing any personally identifiable or other similar user data in the course of proving our services. This Privacy Policy is applied to personal data that we collect about the visitors of our website (later “you”). This Privacy Policy describes what kind of personal data we receive and collect through your use of our website and how we process such personal data in our customer and marketing data filing system.

By using our website, you consent to the data practices described in this Privacy Policy. If you do not agree with the data practices described herein, you should not use our website. We may update this privacy policy from time to time, for example due to changes in applicable legislation, which is why we recommend that you occasionally review this privacy policy for any changes. Boudin SaaS product is called Boudin Analytics. Boudin Analytics provides skills related analyses and insights on the effectiveness of training. Privacy Policy of Boudin Analytics is defined in a separate delivery agreement between Boudin and the customer.

  1. What Personal Data Do We Collect and How?

We collect certain personal data about you that we receive automatically when you use our website. This includes information concerning the exploitation of our website and content, technical information from your browser as well as the cookies and information related to them.

In addition, personal data are collected by voluntarily submit on our website:

The basis for processing your personal data is our legitimate interest based on our purposes of use determined below. We may also send you electronic direct marketing messages based on your consent.

Our websites may include links to third party websites. Please take into account that we don’t control, and aren’t responsible for, the content of practices of such websites, which are also subject to their own terms and privacy policies.

7.Transfers of Your Personal Data outside the EU or European Economic Area  

In order to ensure proper functioning of our website, we may need to share and transfer your information outside the EU/EEA, e.g. if our servers are located in an another country. You expressly consent that Boudin Oy has the right to share and transfer your information freely within the EU/EEA for the purposes described in this Privacy Policy.

We transfer your personal data outside the European Union or the European Economic Area in accordance with the data protection legislation. The operators we transfer your data are as follows: Amazon Web Services, Louhi Oy, Google LLC and LinkedIn.

In all situations, we transfer your personal data outside the EU or the European Economic Area only based on one of the lawful grounds mentioned below:

  • the EU Commission has decided that the recipient country in question ensures an adequate level of protection
  • we have established appropriate safeguards for the transfer of personal data by using the standard data protection clauses approved by the Commission. You shall then have the right to obtain a copy of such standard clauses by contacting us in the manner described in the section ‘Contacts’, or
  • you have given your explicit consent for the transfer of your personal data or another lawful basis for the transfer of your personal data outside the EU or EEA exists

We will retain your personal data for the period of time required for the processing purposes set out in this privacy policy. We will in any case remove your personal data at the latest after two years from the collection of the personal data.

Your personal data may be retained for longer if applicable legislation or our contractual obligations towards third parties require a longer retention period.

You should present your request for exercising any of the aforementioned rights in the manner described in the ‘Contacts’ Section of this Privacy Policy. We may ask you to specify your request in writing and to verify your identity before processing the request. We may refuse to fulfil your request on grounds set out in applicable data protection legislation.

You also have the right to lodge a complaint with the supervisory authority concerned or with the supervisory authority of the EU member state of your habitual residence or place of work, if you consider that we have not processed your personal data in accordance with applicable data protection legislation.

We respect the confidentiality of your personal data. We employ several security technologies and measures to protect and prevent your personal data stored on our servers from unauthorized access, use and disclosure. Our servers are located in a controlled and secured environment and user credentials are required to access the environment and personal data.
